You May Be A Loser (Does the Recent Publishers Clearing House Class Action Lawsuit Portend Changes in Sweepstakes Law?)

On April 23, 2018, 13 disgruntled senior citizens, led by a retired and disabled veteran who for seven years purchased hundreds of items from Publishers Clearing House (PCH) believing this would increase his chance of winning the PCH Sweepstakes, sued PCH in federal court in New York claiming PCH was guilty of a number of deceptive trade practices.

For years PCH has been the poster child for questionable sweepstakes and a lightning rod for investigations.  Everyone knows it’s “You May Already Be a Winner” slogan (at least we do here), and that at any moment they may creep up to your house, ring the doorbell like a hyperactive kid on Halloween, and pounce on you with a ginormous winner’s check.  And for years, consumers and regulators alike have been patrolling the PCH Prize Patrol, this time with a multi-million dollar lawsuit that reads like a primer on sweepstakes law. Win Tickets to Opening Day, But How Do I Get There?

Today (March 29th) is baseball’s opening day – the earliest opening day in history.  If you’re going to the Yankees’ opener in Toronto, wear your ski caps it’s going to be 9 degrees Celsius – which sounds cold.

I bring up baseball because I noticed on mlb.com that there are sweepstakes that have been running for the opportunity to win tickets to different opening day games.  Note: tickets only.  As stated in the Official Rules: “TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED.”  Eligibility: Legal U.S. and Canadian residents (of course, excluding Quebec), 18 or older. Time to Take Your Shot: Prize Indemnity Insurance Edition

We’re getting into the swing of the basketball and hockey seasons and you know what that means?  (Yes, the Knicks still haven’t been mathematically eliminated.)  But also, it’s time for the Half-Court Shot Contests and Blue Line Shot Contests to give weekend warriors the chance to quit their day job.

Prizes can range from a few hundred dollars to a few hundred thousand dollars.  All you need to do is shoot a 9.55 inch diameter ball a distance of 94 feet into an 18 inch diameter hole.  Or, shoot a 3-inch puck a distance of 90 feet into a hole about 4 inches wide – while standing on ice.  If you’re not Meadowlark Lemon, your odds of making the half-court shot are about 1 in 50.  And the odds of scoring on that one-timer are much higher, even if you’re Wayne Gretzky.

Because lightening always strikes, there is Prize Indemnity Insurance.  You don’t need to break the bank just because some hotshot broke the odds. (more…)

Some things you may not be able to give as prizes:

– Smokes (MA, MI, VA)
– Gas (NJ, VA)
– Beer (many states)
– Milk (restricted in a number of states)
– iPad (formerly)
– Yankees tickets (because they may contain a no-transfer provision)
– Puppies (most states)

Age Doesn’t Matter Except When it Does

Marx once remarked, “Age is not a particularly interesting subject.  Anyone can get old. All you have to do is live long enough.”  Well, thanks Groucho, for that word of advice, but let’s look anyway into the importance of age in sweepstakes.

Minimum Ages

13 or older:

If the promotion is online and is directed to a child or will collect information from a child, it needs to be 13 or older, unless you want to comply with the requirements of the Children’s Online Privacy Protection Act (COPPA). (more…)

Vacation Sweepstakes Edition (The More You Give, The Less You May Get)

It’s summer vacation time and what better way to spend it then basking in the sun after winning that all-expense-paid prize trip.  Or is it?

Sponsors want to create buzz for their sweepstakes.  And vacation prizes over the summer months may do just that.  In my unofficial count, there are about 150 vacation sweepstakes currently running by major brands for trips to Hawaii, Lake Tahoe, Disney World, Miami, Las Vegas, NYC and even Cincinnati.  But Caveat Sponsus, awarding a dream vacation could be a nightmare.
